SERVICE CONTRACT

All clients of JERUSALEM Hebrew Academy (JHA) must agree to the terms of service contract .PDF file found on this page.  The file should be signed and emailed to miqdashacademy@gmail.com before making payments or attending classes.  We are more than happy to help you with this process if assistance is needed.  Just write "service contract" in the subject line of the email:  miqdashacademy@gmail.com

RESCHEDULING
 

"Life Happens"

ONE-ON-ONE

Client can reschedule one-on-one classes once per month at no extra charge, with 48 hour advance notice.  JHA cannot commit to rescheduling every student multiple times a month.  If rescheduling more than once in a single month is feasible for us, it may be possible for a $15 fee.  The $15 charge is dropped if you can find a new student to replace you for the originally scheduled class.  Feasibility is dependent upon the amount of students wishing to reschedule in that given month as well as dependent upon compatibility with our other preexisting plans and commitments.

GROUP CLASSES

Clients are assured a place in the group class paid for and at the scheduled date and time agreed to at the beginning of the month.  JHA cannot commit to the ability to reschedule every student of group classes, upon demand.  If rescheduling is feasible, it may be possible for a $15 fee.  Feasibility is dependent upon the amount of students wishing to reschedule in that given month as well as dependent upon compatibility with our other preexisting plans and commitments.  All rescheduling and cancelations should be documented by email.

TUTOR RESCHEDULES

If the tutor needs to reschedule, he should inform the class 48 hours in advance.  If the class is informed 48 hours in advance, the class can be rescheduled without consequence.  If the tutor wishes to reschedule the class less than 48 hours in advance, a $10 discount will be given the next month for those clients who request it in email before arrival of the next billing date.  Subject line of the email must state "$10 DISCOUNT" and the email must state the reason for the discount and the date of the missed class.  If the tutor misses a scheduled class without advanced warning, a $15 discount will be given the next month for those clients who request it in email before arrival of the next billing date.  Subject line of the email must state "$15 DISCOUNT" and the email must state the reason for the discount and the date of the missed class.

CLASS CANCELATION

ONE-ON-ONE

Client is not charged any extra charge for canceling a one-on-one class if the tutor is given at least 24 hour advanced notice via email.  The email subject line must say "CANCEL CLASS" and specify the date and time of the class that should be canceled.  The email must be received at least 24 hours before the regularly scheduled class that is canceled.  Canceling a class less than 24 hours in advance will incur a $10 fee.  If the class was not canceled in advance and the scheduled class is a "no-show" (the student is absent), the client will be charged $20.  A class is automatically regarded as a "no-show" if the student does not contact the tutor within the first 12 minutes of the scheduled class.  In such a case, the class is automatically canceled.  If the client contacts the tutor before 12 minutes into the class, updating them that they will be less than 30 mins late, the class is not automatically canceled.  If they will be 30 mins or more late, the class is canceled and a $20 fee will be charged.

GROUP CLASSES

Group classes are never canceled at the request of one single student participant.  Group classes function as a subscription.  The client pays for the subscription which grants access to regularly scheduled classes.  The client has the privilege to join a live class or to view a recording of the last class.  If the client has any questions related to the lesson, they can either email the tutor directly or post the question in the class forum or under the recorded video.

TUTOR CANCELS

The tutor commits to the agreed upon schedule of a class as established at the beginning of every month.  The tutor shall not instigate the cancelation of a scheduled class unless for medical emergencies or similar exceptional circumstances beyond their control.  When possible, the tutor will inform students via email at least 48 hours in advance if circumstances require the cancelation of a class.  The tutor commits to rescheduling the class per the rescheduling agreement above.

CONTRACT CANCELLATION

ONE-ON-ONE

This contract is in force for the fullness of the month of the client's last payment.  The contract is automatically renewed every month unless it is either canceled or amended via email between the client and tutor.  Amendments and cancelations must be documented in an email between the parties (client and tutor) in order to be considered legally effective.  If a monthly payment from the client was fully processed and deposited without the client's knowledge, the payment can be refunded at the request of the client so long as the refund is requested within a week from the day of the deposit, on the condition that the client did not attend a class within a week from the time of the deposit.  The counting of 7 days from the time of the deposit includes the day of the deposit.  This contract releases the tutor, or JHA, from legal requirement to return a payment if an emailed request from the client for a refund is not made to the tutor, or JHA, within those first 7 days of the deposit - which includes the day the deposit was processed.

TUTOR CANCELS

The tutor, or JHA, retains the right to terminate the renewal of this service contract at the end of full month period from the date of the first payment.  If the tutor, or JHA, decides to terminate the renewal of a contract, they shall inform the clients via email at least a week in advance that the contract will not be renewed the following month.  Termination of contact means release of liability for payment of services.

GENERAL

Clients and students of group classes consent to their lessons being recorded.  The tutor cannot assure that all of a student's language goals will be reached.  Reaching personal goals depends on independent study as much as it depends on attendance of classes, focus during classes, and willingness to interact and ask questions.  Our classes will give a person the tools to make noticeable progress in the Hebrew language within the span of one year.  The extent of that progress will vary from person to person, dependent on a variety of factors.  We commit to doing our best to serve and assist each student in reaching their goals.  The tutor retains the ability to amend any of the conditions of this contract on an individual basis, with the documented written agreement of the client.  Without the client's agreement to any adjustments to this contract, this contract remains binding in the form that it was when signed by the client and emailed to the tutor.
